TERMS & CONDITIONS

What each section says

 

  1. Price

Our quote is valid for two weeks and is the price you pay unless you want to amend the specification, or the government decides to change VAT or introduce a new tax.

  1. Payment Terms (supply of units/appliances only)

This applies only if we are providing the kitchen units and/or appliances, but not installing.

You pay:

This applies where we are supplying the units/appliances and are installing them. You pay:

  1. Warranties

This section details our commitment to you in respect of the quality of our product and what to do when things go wrong. It sometimes happens!

  1. Specifications

When we have prepared the specifications, you need to make sure they are right. If you subsequently want to change them then it probably can be done but this can potentially affect the cost and time of delivery. We will always do our best to keep any additional cost to a minimum.

 

 

 

 

Kensington Scott – Terms & Conditions

  1. Price
    • The price quoted will include VAT (Unless otherwise stated). VAT will be charged at the rate applying at the time of invoice.
    • Our quotation lapses after 2 weeks (14 days) (unless otherwise agreed).
    • Unless otherwise stated, the final invoice will be for the amount quoted, subject to:

Rates of tax and duties that are introduced, amended, or abolished between the date of the quote and the date of the invoice (See 1.1 in respect of VAT).

 

  1. Payment terms (Supply of units/appliances only)
    • A first payment on account representing 50% of the final quotation agreed between us, subject to changes (see 1.3), is payable at time of order. This deposit is non-refundable (see 6.1).
    • The remaining 50% is payable on the week of delivery.

 

  1. Payment terms (supply and installation of units/appliances).
    • A first payment on account representing 40% of the final quotation agreed between us, subject to changes (See 1.3), is payable at time of order. The payment is non-refundable. This payment is used by us to place orders for kitchen units and appliances from our suppliers.
    • The second payment on account representing a further 57.5% of the final quotation agreed between us, subject to changes (see 1.3), is due on the start of works, or the week of delivery of units (whatever is sooner). This payment is non-refundable and covers our committed costs in respect of labour, materials and remaining services and appliances.
    • The final payment of 2.5% will be payable following the completion of scheduled works.
    • Any items or changes to the original contract, that are requested once installation has commenced, must be paid for in full upon order.
    • Failure to meet any payment within the agreed terms may result in daily interest being charged at the prevailing Bank of England base rate plus 5%.

 

  1. Warranties
    • We warrant our workmanship for 1 year from date of completion.
    • We warrant the goods supplied comply with their description and are free from defect at the time of delivery.
    • If you believe that we have delivered the wrong goods, or they are defective in materials or workmanship you must inform us, with full details, within seven days of the date of delivery and allow us to investigate and give us a fair chance to inspect any defective goods.
    • If the goods are found to be the wrong goods because of an error on our part or they are defective in material or workmanship (following our investigations) we will replace those goods or provide a refund at your option.
    • We are not liable for any other loss or damage (including indirect or consequential loss, financial loss, loss of profits or loss of use) arising from contract to the supply of goods of their use.
    • Our total liability to you for damage to the property caused by our negligence is limited to two million pounds.
    • For all other liabilities not referred to elsewhere in these terms and conditions our liability is limited in damages to the price of the good supplied. Nothing in these terms restricts or limits our liability for death or personal injury resulting from negligence.

 

  1. Specifications
    • If we prepare goods in accordance with your specifications or our instructions, you must then ensure that the specification or instructions are accurate. You must ensure that goods prepared in accordance with those specifications or instructions will be fit for purpose for which you intend to use them.
    • If you change the specification in the supply and/or installation of the goods you will be liable for the additional costs. However, we will endeavour to minimise these additional costs. Any change in specification may also result in delays in ultimate delivery given production/supply lead times.

 

 

All brochures and other promotional materials are to be treated as illustrative only. Their contents form no part of any contract between us and you should not rely on them when entering any contract with us.

 

The only statements upon which you may rely in making a contract with us, are those made in writing by someone who is (or whom you reasonably believe to be) our authorised representative and either:

  1. Contained in our estimate (or any covering letter) and not withdrawn before the contract is made; or
  2. Which expressly state you may rely on them when entering the contract.
